Big Setback for Trump:U.S. Supreme Court Stays Citizenship Decision

President Donald Trump has faced a significant setback from the U.S. Supreme Court. The court has imposed a stay on the Trump administration’s proposal to ban birthright citizenship.

Three federal judges, in separate rulings, issued injunctions to block Trump’s order that aimed to end citizenship for children born in the United States. The judges stated that this order directly violates the 14th Amendment, which has long granted citizenship to nearly all individuals born in the U.S.

For now, the U.S. Supreme Court will not decide whether Trump’s decision is constitutional. The court will also consider the technical issue of whether lower court judges can issue orders to block presidential policies nationwide.

 

 The Supreme Court, while imposing a stay on the proposal, stated that it will hold a hearing on May 15 to address whether district judges have the authority to issue nationwide orders. It is rare for the court to schedule arguments for emergency appeals. If the Supreme Court agrees with Trump’s argument that judges have exceeded their authority, it could allow the government to immediately implement its citizenship policy in some regions.

Last month, the Trump administration filed an emergency appeal in the Supreme Court, urging the court to either lift or reduce these injunctions. The government argued that lower court judges should not have the authority to make decisions that block a policy nationwide.

On the first day of his second term, Trump issued a new citizenship order stating that children born in the U.S. to parents who are undocumented or on temporary visas would not be granted citizenship.
